2020 Pilot Terms of Use

In an effort to support our schools during this difficult time, HMH is offering the use of certain products, free of charge, through July 1, 2020.


Where Pilots are permitted by applicable law and otherwise available, the following terms, in addition to the K-12 Programs Standard Terms and Conditions [/terms-of-use/k-12-standard] and K-12 Learning Platforms Privacy Policy [/privacy-policy-k12-learning-platforms] shall apply. Unless otherwise stated, all capitalized terms are defined in the K-12 Programs Standard Terms and Conditions linked above.

ACCESS. Certain schools and districts(the “Customer”) may be granted access to the Products in the Pilot (the “Pilot Materials”) upon acceptance of these Pilot Terms of Use.  Customer access will automatically terminate on July 1, 2020, after which time Customer will no longer have access to the Pilot Materials.

PILOT MATERIALS. Pilot Materials shall be provided in specified quantities and only for the duration and otherwise within the scope of the Pilot. Participation in the Pilot shall not entitle Customer to participation in future pilots or to continued access to Pilot Materials or to other instructional materials after July 1, 2020. Customer may elect to purchase the Products that are the subject of the Pilot after termination of the Pilot by contacting an HMH account executive.  HMH may terminate the Pilot upon prior written notice to the Customer.

DISCLAIMER.  HMH retains all right, title and interest in and to any Pilot Materials.  Customer is responsible for ensuring that its users have the appropriate equipment and technology required to properly use the Pilot Materials.  THE PILOT MATERIALS ARE PROVIDED ON AN "AS IS" BASIS, AND HMH EXPRESSLY EXCLUDES THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. HMH DOES NOT GUARANTEE THAT THE PILOT MATERIALS WILL BE DELIVERED ERROR-FREE OR UNINTERRUPTED. HMH DOES NOT CONTROL THE TRANSFER OF DATA OVER COMMUNICATIONS FACILITIES, INCLUDING THE INTERNET, AND DIGITAL PRODUCTS MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF SUCH COMMUNICATIONS FACILITIES.
